This book evolved from our interest in rape as feminists and as sodal sdentists. As feminists, we were concemed about the treatment of rape victims and the attrition in rape cases under traditional rape law, and we welcomed legal reforms designed to improve the situation. As sodal sdentists, we wondered about the efficacy of legal changes aimed at an inherently resistant court system. We also were curious about the lack of studies examining the impact of these changes; we were particularly surprised to find that no one had attempted to ana­ lyze the impact of the reforms in more than one jurisdiction. Con­ vinced that untangling the effects of the reforms from the effects of contextual factors required a multijurisdictional study, we deeided to undertake the project. We quickly discovered that evaluating rape law reform in several jurisdictions would be no easy task. We had deeided that such an evaluation would require monthly data on the outcome of rape cases before and after the reforms were implemented, as weIl as qualitative data on the attitudes of criminal justice officials toward the reforms. Because states do not generate monthly data on case outcomes, we would have to collect the data ourse1ves from court records main­ tained by individual jurisdictions. To obtain an adequate number of cases for the time-series analysis, we would have to select our sites from large urban jurisdictions scattered throughout the United States.

Over the past several decades the seeming escalation of crimes involving sexually deviant, coercive, and aggressive behavior has become an increasingly serious problem, manifested in costs to both victims and society at large. The long-term psychological impact of sexual assault on adult and child victims has been documented numerous times. The costs incurred by society include a network of medical and psychological services provided to aid victim recovery, the investigation, trial, and incarceration of offenders-often in segregated units or special facilities-and the invisible but tangible blanket of fear that forces potential victims to schedule normal daily activities around issues of safety. Despite the gravity of the problem, there has been a paucity of empirical research directed at the etiology, course, remediation, and management of sexually deviant and coercive behavior. In treating these disorders and in making crucial decisions about how to manage these offenders, clinicians have been forced to rely on their personal experience. Such experience by its nature is unsystematic and lacks the validation that empirical research provides. The lack of sound empirical data addressing the problem is certainly noteworthy, though not surprising. Crystal Feimster breaks new ground in her story of the racial politics of the postbellum South by focusing on the volatile issue of sexual violence. Pairing the lives of two Southern women—Ida B. Wells, who fearlessly branded lynching a white tool of political terror against southern blacks, and Rebecca Latimer Felton, who urged white men to prove their manhood by lynching black men accused of raping white women—Feimster makes visible the ways in which black and white women sought protection and political power in the New South. While Wells was black and Felton was white, both were journalists, temperance women, suffragists, and anti-rape activists. By placing their concerns at the center of southern politics, Feimster illuminates a critical and novel aspect of southern racial and sexual dynamics.
