9781628100341 | 3 new edition (West Academic, January 2, 2015), cover price $215.00 | About this edition: The distinctive feature of this Federal Courts casebook, and the main difference between it and other Federal Courts books, is its systematic focus on remedial issues, especially the problems that arise when a litigant tries to enforce federal constitutional rights against state or federal governments and officers in the federal courts.
This casebook provides detailed information on federal courts and the law of federal-state relations. Part I explores the intersection of federalism and separation of powers that provide the constitutional foundations of a modern Federal Courts course. Part II covers jurisdiction, and Part III deals with Federal Court enforcement of Federal rights. The final chapter is devoted to certain technically complex questions of remedial interaction, notably the relation of federal habeas corpus to Section 1983. The Seventh Edition of this established casebook features a new co-author, Curtis A. Bradley of Duke, and, to an extent, a new agenda. In line with Professor Bradley’s interests, the intersections between federal courts and international law have been developed in considerable detail. Additionally, the Seventh Edition features a completely restructured habeas chapter, designed to present this increasingly complicated body of law in an more approachable manner. Topics include:

The four years since the publication of the 5th edition the last years of the Rehnquist Court and the first year of the Roberts Court have seen many changes and transitions. The Supreme Court has continued to refine or alter doctrines of federal jurisdiction, including doctrines regarding state sovereign immunity, habeas corpus, federal question jurisdiction, supplemental jurisdiction, and others. The 6th edition contains a number of new Supreme Court cases as principal cases, including Grable & Sons Metal Products, Inc. v. Darue Engineering & Manufacturing on federal question jurisdiction, Exxon Mobil Corp. v. Allapattah Services, Inc. on supplemental jurisdiction, and Marshall v. Marshall on the probate exception to federal jurisdiction. Many other recent cases are discussed extensively in the notes, including Nevada Dept. of Human Resources v. Hibbs, Tennessee v. Lane, and Central Virginia Community College v. Katz on state sovereign immunity, and Vieth v. Jubelirer and LULAC v. Perry on political questions. There is also a new discussion of habeas in the context of the war on terrorism. Throughout, the 6th edition maintains the core pedagogic structure and values that have characterized the book since its very first edition.

This text reflects the authors' decided view that two power relationships are fundamental: the states versus the federal governmentâfederalismâand the federal judiciary versus Congressâseparation of powers (though many of these power struggles are played out in the context of disputes between the individual and government, a third type of power relationship.) The federal courts' primary role is to regulate these conflicts and that is what the authors want to make clearâthat federal courts are special, not just another hierarchical court system.
