On October 25, 1999, the UN Security Council adopted Resolution 1272, whereby it was decided to create a UN Transitional Administration of East Timor (UNTAET). UNTAET was entrusted with overall responsibility for the administration of East Timor and allowed to exercise all legislative and executive functions, including the administration of justice. With Regulation (2000/11), UNTAET created a judicial system based on international norms concerning the administration of justice. In accordance with Article 10.3 of the UNTAET Regulation (2000/11) and Article 1.1 of the Regulation (2000/15), a special judicial mechanism was added to the District Court of Dili. In addition, and in conformity with the dispositions of the above Regulations, another judicial mechanism was added to the Court of Appeals of Dili to hear and decide on appeals lodged against the judgements handed down by the Trial Chamber. Together, both these mechanisms are known as the Special Panels for Serious Crimes. This book presents the history, work, and backgrounds of the Panels.

On December 10, 2003, the US-appointed Iraqi Governing Council approved a statute establishing the Iraqi Special Tribunal for Crimes against Humanity. Following the Iraqi Transitional National Assembly election, the Iraqi Transitional Government was established in May 2005. In August of that year, the Iraqi Transitional National Assembly adopted a new Statute of the Iraqi Special Tribunal, which changed its name to Higher Criminal Court and brought its practices more into line with the rest of the Iraqi judicial system. The Iraqi Special Tribunal is designed to prosecute those accused of crimes against humanity, war crimes, and genocide in Iraq from July 1968, when Saddam Hussein's Bath Party seized power, to May 2003, when President Bush declared that major combat operations in Iraq were over. The court also has the authority to try several lesser crimes, including the squandering of public funds and attempts to manipulate the judiciary. Arrests of people suspected of committing gross human rights violations in Iraq have been carried out since the start of occupation and have continued following the transfer of power. This book illustrates the work of the Tribunal and presents the cases brought before the court.

No aircraft disaster in history has produced the amount of legal wrangling as the bombing of Pan Am Flight 103 over Lockerbie, Scotland, on December 21, 1988, in which 259 passengers and crew members and 11 people on the ground were killed. The Lockerbie families wanted justice in the name of their relatives that died in the aircraft, but only in 1996 did the US Administration and Congress amend the Foreign Sovereign Immunities Act with the Anti-Terrorism and Effective Death Penalty Act that allowed civil actions against Libya. Libya was finally served, under the provisions of the Act, in 1997, and answered the complaints, asserting in its answers that the underlying statute was unconstitutional. One area of the Lockerbie litigation was the unusual use by Libya of an international treaty called The Montreal Convention of 1971 for the Suppression of Unlawful Acts against the Safety of Civil Aviation. The purpose of this treaty was to prevent attacks against civil aircraft and provide for cooperation between countries when there has been such an attack and to provide appropriate measures to punish offenders. It was not meant to give jurisdiction over criminal proceedings to the country of the alleged wrongdoer. This book contains legal materials related to the Lockerbie Trial and examines this landmark case in international criminal law. (Series: International Courts and Tribunals Cases - Vol. 4)
