The authors added problems that raise interesting evidentiary issues not covered in the prior editions. Many problems have been rewritten and all have been edited to make sure they are all readable, easily understood, and accessible to today’s law students. Authors also have modernized the problems to take into account current technology, especially in dealing with demonstrative evidence and writings. Problems in Evidence, 4th can be used with McCormick's Hornbook on Evidence (West Group, 5th ed. 2000) and no casebook. Citations are given after each problem to the appropriate McCormick sections and to the applicable Federal Rule of Evidence. (view table of contents)

The most significant change in the Seventh Edition deals with the revolution in Confrontation Clause jurisprudence occasioned by the Supreme Court's decisions in Crawford v. Washington (2004) and Davis v. Washington (2006). The confrontation section of the book in Chapter 13 is completely revised and substantially expanded. Extensive notes describe the operation of the earlier system of confrontation analysis, the immediate impact, and the areas of continuing uncertainty under Crawford and Davis. The new edition also continues the trend in the Sixth Edition, which dramatically revamped the book's treatment of scientific evidence, and includes a number of new cases and notes regarding scientific evidence because of the dynamic nature of that particular area of evidence law.

Volume One of Two Volume Set. McCormick on Evidence, 5th, is an analysis of the rules and theory of the law of evidence. It covers not only the Federal Rules of Evidence, but also state law in jurisdictions not following Federal Rules. Describes accepted practice and theory, identifies current issues, and reviews leading case law. When there are specific questions of evidence for which a jurisdiction has no precedent, the book provides both general theories that may be argued to suggest the answer and varying views from other jurisdictions.
