Elderly Clients: A Precedent Manual provides a comprehensive wealth of precedents to assist the private client adviser in tackling the whole range of issues that affect elderly clients in the UK. These include the difficult and ever-changing problems of planning for a client's possible incapacity in later life, care contracts, funeral planning, wills, and equity release schemes. In addition to the UK precedents, useful checklists assist the adviser in such matters as registering a lasting power of attorney and establishing whether the client has authority to make a will or gift. Each chapter of this third edition has been thoroughly revised to take account of all major developments including: the UK's Mental Capacity Act 2005 (affecting lasting powers of attorney, mental capacity issues, deputyship [replacing receivership], new law and practice on statutory wills, and the statutory basis for a living will); the Health and Social Care Act 2007 (covering changes to care homes); and case-law changes (affecting areas such as wills and sharing residential property).
